EasyCap Privacy Policy Agreement

This "Privacy Policy Agreement" (hereinafter referred to as "this Agreement") is entered into between [Shanghai Jushen Intelligent Technology Co., Ltd.] (hereinafter referred to as the "Company"), the operating entity of "EasyCap AI Short Video" (hereinafter referred to as "EasyCap"), and the user (hereinafter referred to as "you"). it is a valid contract reached by both parties regarding the protection of personal information. EasyCap provides services to you in accordance with the provisions of this Agreement, and this Agreement has the force of a contract. Your use of EasyCap services will be deemed as acceptance of the purpose, method, and scope of personal information collection and use stipulated in this Agreement, and agreement to be bound by the terms and conditions of this Agreement.

By clicking or checking the "Agree" button on relevant EasyCap pages or otherwise confirming your consent/acceptance of this Agreement (such as clicking subsequent operations on relevant pages, actually enjoying the rights and interests under this policy, or actually accepting the services provided by EasyCap, etc.) ("Confirmation"), you signify that you confirm and accept all the agreed contents of this Agreement. You confirm and agree that this Agreement is concluded in electronic form and has the same legal effect as a written form. To continuously improve product and service quality, we may introduce new functions or optimize and upgrade existing functions from time to time based on technological developments and business needs. These improvements may involve the collection and use of new personal information, or adjustments to the purpose and method of using already collected personal information. In such cases, we will clearly explain the purpose, scope, and method of use of the relevant information collection to you through updates to this privacy policy, pop-up notifications, page prompts, or other appropriate methods, and provide you with the option to choose whether to agree independently. We will only collect and use your personal information in the new way after obtaining your explicit consent. If you do not agree to the content of this Agreement, or cannot accurately understand the meaning of any terms of this Agreement, please do not click confirmation or use the service.

1. Information necessary to maintain normal service operation and ensure transaction security

When you use the EasyCap APP, in order to identify abnormal account status, ensure product compatibility, guarantee your normal use of our services, maintain normal service operation, optimize service experience, and protect your account security, we will collect the following information based on your specific operations during software installation and/or usage:

  • Device Information: including hardware name, model, device MAC address, UUID, IDFA, IMEI, IMSI, etc.
  • Operating System Information: including operating system version, type, etc.
  • Network Information: including login IP address, network access method, type, status, and name
  • Software Information: including EasyCap software version number, mobile application list, etc.
  • Approximate Geolocation Information: including GPS location you authorize and information from WLAN access points, Bluetooth, and base stations
  • Log Information: including your operation logs, server log information (may include information you searched, viewed, service failure information, referral URL information, etc.)

This information is the basic information necessary for providing mobile internet application services, used to implement push services, network services, instant messaging, and other functions. The expression of device information may vary depending on the system (Android/iOS).

1.1 You can choose whether to authorize us to collect and use your personal information In addition to the information mentioned above necessary to ensure normal service operation, you may choose whether to authorize us to collect and use other personal information.

1.1.1 Extended business functions based on device permissions

  • (1) Obtaining approximate geolocation information To determine your current location, we will collect your device's location information, but only for your current geographic location and will not combine location information at different times to track your movements. With your consent, we will obtain location information through IP address, GPS, and possibly other sensors (such as WiFi access points and base station information). You can share published information with third parties via SMS or WeChat, but please note that this may expose your or the transaction counterparty's location information. It is recommended to operate cautiously after obtaining the other party's consent. If you refuse us to obtain location information, manual positioning is required.
  • (2) Voice functionality You can record videos or send voice messages through the microphone. During use, the relevant service provider needs to collect your voice content and process it as necessary. You can decide whether to use the microphone feature.
  • (3) Camera functionality You can authorize EasyCap to access your camera for video recording or taking photos.
  • (4) Photo album access You can authorize EasyCap to access your photo album to use photos, media content, and files.
  • (5) Permission management Implementing the above functions may require you to enable corresponding permissions on your device, including location, microphone, camera, and photo album.

You can check the permission status in EasyCap under ["My" — "Settings" — "Agreements and Terms"] and enable or disable these permissions at any time (please refer to section 1.1.2 for specific settings). Enabling permissions means you authorize us to collect and use relevant information to achieve the corresponding functions; disabling permissions means you revoke authorization, we will stop collecting and using this information, and cannot provide related functions. The decision to disable permissions will not affect previously authorized personal information processing.

1.1.2 To enable or disable system privacy permissions for EasyCap APP on your phone, go to [“Settings” — “Applications” — “Permission Management”], find EasyCap APP, click to enter, and choose to disable or enable app permissions. After disabling the related permissions, we will no longer continue to collect your relevant information, and relevant functions may be restricted or unavailable.

1.2 To ensure basic business functionality, we may share data with third parties via APIs or SDKs. Before you explicitly agree to this privacy policy, EasyCap APP will not collect or use your IMEI, IMSI, MAC address, application list, etc. We will only share your information with third parties within the legal, legitimate, necessary, specific, and explicit purposes stated in this privacy policy. Such potential partners include but are not limited to: video recording service providers, beauty effect display service providers, technical infrastructure service providers, identity verification service providers, push message service providers, SMS operators, third-party payment institutions, and providers, contractors, and agents offering location processing services.

We use SDKs from relevant third parties:

(1) Umeng Analytics SDK

  • Purpose: APP operation statistics and analysis; generate a de-identified unique end-user device identifier based on device information to ensure SDK service; use approximate location for regional application analysis and provide regional data reports; uninstall analysis: use application list to achieve installation and uninstall statistics;
  • Operator: Umeng Tongxin (Beijing) Technology Co., Ltd.
  • Umeng SDK needs to collect your device MAC address, unique device identifier (IMEI / AndroidID / IDFA / OPENUDID / GUID, SIM card IMSI information) to provide statistical analysis services, and calibrate report data accuracy via geolocation to provide basic anti-fraud capabilities.

3. According to the requirements of national laws and regulations for real-name registration (real identity information authentication), we need to collect your mobile phone number to complete account binding. If you refuse to provide your mobile phone number, you will not be able to complete the real-name authentication.

4. Users shall not use new technologies and applications based on deep learning, virtual reality, generative artificial intelligence, etc., to produce, upload, copy, transmit, or disseminate false news information or other information content prohibited by laws and regulations, nor shall they falsely claim synthetic content as natural content. When you publish or disseminate non-real information produced using new technologies and applications such as deep learning, virtual reality, and generative artificial intelligence, you should label it in a prominent manner; otherwise, Shanghai Jushen Intelligent Technology Co., Ltd. has the right to take measures against relevant content and accounts, including but not limited to adding labels, imposing restrictions, or banning.

5. If you are a minor under the age of 18, you should carefully read and agree to this agreement under the supervision and guidance of your guardian and with the consent of your guardian before you can use EasyCap and related services. If you have not obtained the consent of your guardian, the guardian can notify Shanghai Jushen Intelligent Technology Co., Ltd. to handle the relevant account through the official customer service contact information published by the company. Shanghai Jushen Intelligent Technology Co., Ltd. has the right to restrict the functions and use of the relevant account, including but not limited to functions such as browsing, publishing information, and interactive communication.

6. In order for the EasyCap APP to provide services to you, any user information, location information, transaction information, privacy information, and permission settings formed during the transaction process will be shared with third-party payment platforms, third-party payment platforms of the EasyCap APP, partners, and other relevant service providers to obtain and use any user information, location information, transaction information, privacy information, and permission settings provided or formed by you. This agreement applies to the collection, use, and sharing of the aforementioned information. The privacy permission authorization settings (non-system permissions) you make will take effect within the EasyCap APP.

7. You agree that the EasyCap APP has the right to change the content of this agreement or other related service terms and operation rules published by the EasyCap APP in accordance with the relevant provisions of the "EasyCap APP User Service Agreement." The EasyCap APP will publish announcements in accordance with the procedures and methods prescribed by law. If you continue to use the services provided by the EasyCap APP, it shall be deemed that you agree to such content changes. If you do not agree to the changed content, you should immediately stop using the services provided by the EasyCap APP.

8. When you fill in information such as your login name and password according to the prompts on the registration page, read and agree to the "EasyCap APP User Service Agreement" and "EasyCap APP Privacy Service Agreement," or actually use the EasyCap APP website services in other ways permitted by the EasyCap APP, you become an EasyCap APP member. You can only use your account through your password. You are responsible for keeping your member login name and password confidential. If you leak your password, you may lose your personal identification information and adverse consequences may arise for you.

9. When you register as an EasyCap APP member, you are deemed to agree to facial recognition by the system, and we require you to fill out a registration form. The registration form requires providing your real name, mobile phone number, email address, or your company's address and name, among other relevant information. If the aforementioned information changes, it should be corrected immediately. If the information provided by the user is untrue or inaccurate, causing any nature of loss to the user themselves or others, the user shall bear all responsibility.

10. When you leave a message for customer service on the EasyCap APP, we require you to fill in the message information, which includes your personal name, phone number, and other relevant information.

11. You are fully aware that the EasyCap APP does not need to obtain your authorized consent to collect, use, or provide the following information to third parties:

(1) Related to the EasyCap APP's performance of obligations stipulated by laws and regulations;

(2) Related to national security and national defense security;

(3) Related to public safety, public health, and significant public interests;

(4) Related to criminal investigation, prosecution, trial, and execution of judgments, etc.;

(5) For the purpose of protecting the significant legal rights and interests of your life or property or those of other users, but where it is difficult to obtain your personal consent;

(6) Your personal information that you have disclosed to the public on your own;

(7) Your personal information collected from legally and publicly disclosed information, such as legal news reports, government information disclosure, and other channels;

(8) Information necessary for entering into and performing a contract at your request;

(9) Necessary for maintaining the safe and stable operation of the products and/or services provided, such as discovering and handling faults in products and/or services;

14. You can log in to the Member Center with your username and password to modify and update the information you have published. After providing valid and true proof, you have the right to request EasyCap APP to cancel or delete the information you have published.

The EasyCap APP will not disclose, edit, or reveal the content of a user's personal profile to third parties without authorization, except as required by government mandates, laws, or regulations. 28. If any dispute arises between you and EasyCap APP due to the content, interpretation, or execution of this agreement, both parties shall strive to resolve it through friendly negotiation; if negotiation fails, either party may file a lawsuit with the people's court having jurisdiction in the place where Shanghai Jushen Intelligent Technology Co., Ltd. is located.

29. Cancellation Instructions: Before you cancel your "EasyCap APP" platform account, please fully understand and agree to the following matters:

We hereby kindly remind you that your cancellation of the EasyCap APP primary account will result in much inconvenience for your transaction rights protection. After your EasyCap APP account is successfully cancelled, we will delete your personal information to keep it in a state that cannot be retrieved or accessed, or anonymize it. You know and understand that according to relevant legal provisions, relevant transaction records must be kept in the EasyCap APP for 3 years or even longer.

29.1. If you still insist on cancelling your EasyCap APP account, your account must meet the following conditions simultaneously:

(1) There is no balance in your EasyCap APP account, and no withdrawn amount that has not yet arrived;

(2) There are no unfinished waybills and no completed but unpaid orders/services in the account;

(3) There are no outstanding debts or other fees in the account;

(4) There are no active orders in the account;

(5) The account is in normal use, without any disputes or restricted records (including but not limited to complaints, reports, or being complained about or reported), and all issues under the account have been resolved.
